Whether Medicare or your employer plan pays first depends on the size of your employer. If your employer has 20 or more employees, your employer plan is the primary payer and Medicare is secondary. If your employer has fewer than 20 employees, Medicare is primary.
If you are covered by a large employer plan (20+ employees), you can delay enrolling in Medicare Part B without penalty — as long as you remain covered by the employer plan. Once that coverage ends, you have an 8-month Special Enrollment Period to enroll in Part B.
If your employer has fewer than 20 employees, Medicare is primary. In this case, you should enroll in Medicare Parts A and B when you first become eligible to avoid gaps in coverage.
COBRA continuation coverage does not count as employer coverage for Medicare SEP purposes. If you are relying on COBRA, enroll in Medicare before COBRA ends to avoid a gap and potential late-enrollment penalties.
